Jennifer Rae Xavier was arrested by police on DUI charges. She was involved in a fatal Tecolote Creek car crash on March 4th 2021. Jennifer has been charged as second-degree murder. Jennifer and Sidnie Walker were going out for a night of fun, which led to a fatal car accident.
Walker suffered brain injuries and trauma that led to his death. Paramedics rushed Walker from Hillcrest to UC San Diego Medical Center. Walker died of brain injuries due to drowning and blunt force trauma to the head. Jennifer was driving a BMW while under the influence alcohol and Xanax, when the car flipped upside down.

Pippa Cunningham, Deputy District Attorney, claims that Xavier was drunk and Xanax when she drove the car to Tecolote Creek.
Waller sustained serious injuries and later died in hospital.
Cunningham stated Thursday that Jenny was able to escape, but her passenger drowned. He also said that additional evidence was found on Xavier’s cellphone by investigators, indicating that she had been involved in other crashes while impaired by drugs or alcohol.
Joel Bailey, Xavier’s attorney, described the incident as a “horrible tragic event.” However, he stated that he believes prosecutors wrongly accused his client of murder.
California Highway Patrol reports that Xavier had been to at least two Pacific Beach bars within hours of the crash. Cunningham stated that Xavier was believed to be driving Waller home from work when she mistook the exit from Sea World Drive to south Interstate 5 and crashed her BMW sedan into Tecolote Creek.
According to the CHP, Xavier was speeding at the time of the accident. Waller was trapped in the car, and she was still under water until San Diego firefighters released her.
According to the county Medical Examiner’s Office, she died of brain injuries from drowning and blunt force trauma to her skull. Paramedics rushed to Hillcrest’s UC San Diego Medical Center. Cunningham says that although Waller and Xavier are both Northern Californians, they lived in San Diego at the time.
Witnesses reported that Waller was trapped in her car and that Xavier was seen walking back to the highway by witnesses. According to the CHP. She accepted a ride from a good Samaritan who did not seem to know the circumstances of the accident.

Cunningham refused to discuss the details of Xavier’s escape, but claimed that she fled the scene without trying to alert authorities.
Two weeks later, Highway Patrol asked the public for information about Xavier’s and Waller’s whereabouts during the hours preceding the crash at 9:10 p.m.
Arrest records indicate that Xavier was taken into custody by a fugitive taskforce and booked in jail Aug. 12.
Bailey, the defense lawyer said that Xavier cooperated in CHP investigations, stayed in San Diego and was in touch with her attorney. She was due to appear in court in approximately two weeks and she planned to do so prior to her arrest.
Xavier was held in custody at Las Colinas Detention & Re-Entry Facility (the women’s prison in Santee) on Thursday.
She was charged by the District Attorney’s Office under a theory for second-degree murder. This means that she knew she was guilty of dangerously injuring human lives but she did it anyway. Prosecutors point out cellphone evidence that Xavier drove under the influence in the past, She was not charged. Next month, Xavier will be back in court.
